Tax Return Deadline Australia 2026: 31 October, the Tax Agent Rule and What Late Lodgment Costs
The 2026 Australian tax return deadline is 31 October (a Saturday this year). How the tax agent extension works, what a late lodgment costs ($364 per 28 days, up to $1,820), when a tax bill is due, and a three-week plan.

If you do your own tax return in Australia, the date to know is 31 October. This year it falls on a Saturday, it comes round at the busiest time of year, and it's very easy to leave until "next weekend" one weekend too many.
This guide covers what the ATO actually says about the 2026 deadline, how the tax agent extension really works (and the date that one depends on), what happens and what it costs if you're late, and a simple plan to get it done in the next three weeks.
The short answer
- Lodging yourself with myTax or on paper: 31 October 2026. The ATO's myTax instructions say: "You have until 31 October 2026 to lodge your tax return for 2026 with myTax, unless we have allowed you to lodge it later" (ATO).
- The "2026" tax return covers 1 July 2025 to 30 June 2026 (the 2025–26 income year).
- 31 October 2026 is a Saturday. Plan to be finished by Friday 30 October.
- Using a registered tax agent can give you a later date, but only if you're on their client list in time. The ATO says to contact an agent before 31 October to be part of their lodgment program (ATO).
- If you owe tax, payment is due 21 November 2026 at the earliest (ATO).
- The late lodgment penalty is $364 for every 28 days late, up to $1,820 for individuals (ATO). In practice the ATO usually warns you first, and generally doesn't issue a penalty notice for a late return that ends in a refund. More on that below.
Who has the 31 October deadline?
Anyone who lodges their own tax return, whether online with myTax (through myGov or the ATO app) or with a paper return. The ATO's myTax page puts it simply: "The due date to lodge your tax return is 31 October" (ATO).
The exceptions are people the ATO has given a different date, and people who are on a registered tax agent's client list in time (see below).
What if 31 October falls on a weekend?
You'll see some tax websites say that because 31 October 2026 is a Saturday, you have until Monday 2 November. We couldn't find that stated on the ATO's own individual lodgment pages, and the ATO's October 2026 calendar for tax agents still lists 31 October as the final date to add new clients. Don't build your plan around a weekend grace period. Treat Friday 30 October as your real deadline, and if you finish earlier, even better.
The tax agent extension: real, but it has its own deadline
This is the part people misunderstand most. The ATO says most registered tax agents have a "special lodgment program and can lodge returns for their clients after the usual 31 October deadline". Your actual date depends on your situation, so ask your agent.
But you don't get the later date automatically just by planning to see an accountant "at some point". The ATO is explicit:
"If you're using a tax agent for the first time, or using a different tax agent, you should contact them before 31 October to be part of their lodgment program." (ATO: Lodge your tax return with a registered tax agent)
The ATO's October 2026 due dates for tax agents list 31 October as the "final date to add new clients to your client list to ensure their 2026 tax return is covered by the lodgment program."
Two catches worth knowing:
- Agents are busy in late October. If you're a new client, get in touch in the next week or two, not on the last Friday. Some practices may not be open on Saturday 31 October.
- Old unlodged returns can cancel the extension. If you had prior-year returns outstanding at 30 June 2026, the ATO's agent calendar says all of them ("not just the immediate prior year") need to be lodged by 31 October 2026 for the later program dates to apply to your 2026 return.
What happens if you lodge late
The penalty
The ATO's failure to lodge on time (FTL) penalty for individuals is one penalty unit for every 28 days (or part of 28 days) that the return is overdue, up to a maximum of 5 penalty units (ATO). A penalty unit is $364 for infringements on or after 1 July 2026 (ATO: Penalty units).
| How late | Penalty units | Maximum penalty |
|---|---|---|
| 1 to 28 days | 1 | $364 |
| 29 to 56 days | 2 | $728 |
| 57 to 84 days | 3 | $1,092 |
| 85 to 112 days | 4 | $1,456 |
| More than 112 days | 5 (the cap) | $1,820 |
What the ATO says it usually does in practice
The same ATO page is more forgiving than the table suggests:
- "Generally, we don't apply penalties in isolated cases of late lodgment."
- If you fail to lodge on time, the ATO says it will "warn you by phone or in writing before we apply an FTL penalty and issue you a notice to lodge."
- It generally won't issue an FTL penalty notice for a late-lodged tax return if the return results in a refund or a nil result, with some exceptions (for example, if the penalty was already applied before you lodged).
So if you're owed a refund and you're a few days late once, the realistic cost is mostly the delay to your own money. If you owe tax, late lodgment is where penalties and interest on the unpaid amount start to matter. The ATO notes that getting up to date "may help you to avoid interest accruing on any tax debts and late lodgment penalties."
"I forgot" isn't an excuse the ATO accepts
You can ask the ATO to remit (cancel) a penalty, and it lists the kinds of reasons it's likely to accept, such as serious illness, a natural disaster, or not having received an income statement from your employer. It also lists reasons it's likely to decline, including:
- "you could not lodge on time because you were on holiday"
- "you could not lodge on time because you were busy with work commitments"
- "you did not receive any reminders to lodge from the ATO"
In other words, remembering the deadline is your job. Which is the whole point of the plan below.
When the tax bill is due
If you lodge on time and end up owing tax, the ATO says your bill is due on the later of:
- 21 November 2026 (21 days after your return was due), or
- 21 days after you receive your notice of assessment.
If you lodge late, the bill is still due 21 November 2026. The date doesn't move just because your return did (ATO). Note that 21 November 2026 is also a Saturday, so plan to pay during the week before.
Don't need to lodge? Tell the ATO anyway
If the ATO's "Do I need to lodge a tax return?" tool says you don't need to lodge a 2026 return, the ATO asks you to tell it by lodging a non-lodgment advice, also called a "return not necessary", "so we don't send you reminders". You can do it in ATO online services through myGov, or with a paper form (ATO).
One trap: if you earned less than the $18,200 tax-free threshold but had tax taken out of your pay, the ATO says you need to lodge a return to get that tax back. A non-lodgment advice won't refund it.
A three-week plan to get it done
Today is the second week of October. Here's a schedule that leaves you a buffer:
| When | What to do |
|---|---|
| This week | Decide: myTax yourself, or a tax agent? If an agent and you're new to them, contact them now. |
| Mon 19 Oct | Log in to myGov and check your income statement and pre-filled data. The ATO pre-fills most employer, bank, health fund and government information by late July, so it should all be there. |
| Week of 19 Oct | Gather receipts and records for any deductions you plan to claim. |
| Sat 24 or Sun 25 Oct | Sit down and do it. myTax works on a phone, tablet or computer, and the ATO says refunds generally arrive within 2 weeks. |
| Wed 28 Oct | If something's missing, this is your last comfortable day to chase it or book an agent. |
| Fri 30 Oct | Hard stop. Lodge. You'll get an email receipt confirming the ATO has it. |
| Mid-November | If you owe tax, pay before 21 November. |
The hardest step is usually the third row: actually blocking out an hour and sitting down to do it. That's the one worth a firm reminder.
How ReminderIt can help
The ATO's own penalty guidance says "I didn't get a reminder" isn't a good excuse, so set your own. ReminderIt lets you create a reminder just by sending a WhatsApp message, then reminds you at the right time, either by calling your phone and reading the reminder out loud, or with a WhatsApp message. If you miss a call, ReminderIt tries once more about five minutes later, and the reminder also reaches you on WhatsApp.
A phone call is harder to swipe away than a notification, which makes it useful for the "sit down and actually do it" moments. A few examples you could send now:
- "Call me on Monday 19 October at 7 pm: log in to myGov and check my pre-filled tax info."
- "Call me on Saturday 24 October at 10 am: do my tax return on myTax. Block out an hour."
- "WhatsApp me on Wednesday 28 October at 9 am: if the tax return isn't done, book the accountant today."
- "Call me on Friday 30 October at 6 pm: last weekday to lodge the tax return."
- "WhatsApp me on Thursday 19 November: pay the tax bill before 21 November."
- "Every year on 1 August at 7 pm, WhatsApp me: tax return is ready to start in myTax."
That last one is the real fix: start in August next year, when pre-fill is ready, instead of in the last week of October.
There's a 7-day free trial with 7 reminder calls. After that it's one plan at $7 a month (₹299 in India), with 70 reminder calls a month and unlimited WhatsApp reminders.

The bottom line
If you lodge your own return, the 2026 deadline is 31 October, a Saturday this year, so finish by Friday 30 October. If you want an accountant's later date, you need to be on their client list by 31 October, so contact them now. A late return costs $364 per 28 days (up to $1,820), although the ATO generally warns you first and usually doesn't penalise an isolated late return that ends in a refund. If you owe tax, it's due by 21 November whatever happens. Put three dates in your calendar today, and make the "sit down and do it" one a reminder you can't ignore.
